4. The decision of the Employee Council shall be transmitted within three (3) working days, in writing, to the complainant. NOTE: Postmark or other proof of deposit with the U. S. mail to the last known address of the complainant shall constitute notification. 5. The record of the hearing, which shall include document(s) submitted by the employee in support of his/her grievance or complaint, document(s) submitted by the College in response to the grievance or complaint, and the written decision of the Employee Council, shall be transmitted to the President of the College. 6. The decision of the Employee Council may be appealed to the President of the East Central Community College District. Notification for such appeal to the President must be given by the complainant to the Employee Council chairperson within five (5) working days after notification that a decision has been rendered by the Employee Council. NOTE: Postmark or other proof of deposit with the U. S. mail will constitute notification provided the correct college address is used. 7. The President shall consider the record of the hearing before the Employee Council in making his/her decision. However, the President, in his/her discretion, may require the submission of additional evidence prior to making a decision on the employee’s grievance or complaint or may schedule a meeting with the employee to discuss the grievance or complaint. In any meeting with the employee to discuss the grievance or complaint, the chairperson of the Employee Council, or the chairperson’s designated representative(s), shall represent the Council. 8. The decision of the President shall be transmitted within three (3) working days, in writing, to the complainant. NOTE: Postmark or other proof of deposit with the U. S. mail to the last known address of the complainant shall constitute notification. The decision of the President of the East Central Community College District on the appeal of an employee grievance or complaint will be final.
