TERMINATION OF SERVICE

Termination of the service of employees at East Central Community College may result from resignation, reduction in force, non-renewal, or dismissal/termination.

Resignation

All full-time contracted personnel desiring to end their service with the College must submit letters of resignation. Resignations must be forwarded, as appropriate, through the organizational structure of the College to the Vice President for Instruction, Vice President for Business Operations or Vice President for Institutional Research & Effectiveness. These administrators will then make their recommendations regarding resignations to the President. All non-contracted employees are “at-will” employees and may resign at any time from employment with the College without providing any prior notice. Recommendations regarding the resignations of administrators and non-contracted personnel are acted upon by the President of the College. Recommendations regarding resignations of faculty are presented by the President to the Board of Trustees who has final approval authority for such matters. Reductions in force may result in the termination of service of employees if extenuating circumstances develop at the College to necessitate such action. Reductions in force may result from, but are not limited to, financial exigencies as declared by the Board of Trustees, from the termination or the reduction of programs as approved by the Board of Trustees, or loss of student enrollment. Employees terminated because of the necessity of a reduction in force may be given some preference in rehiring when conditions permit employment of persons with their qualifications. Upon expiration of an employment contract, the continued employment of a contracted employee shall terminate and the college may refuse to renew or continue the employment of the individual. Contracted employees who are not recommended for reemployment should be notified by the appropriate college administrator after consultation with and concurrence of the President on or before April 1. Failure to provide this notice of non-renewal on or before April 1 does not provide any rights to a contracted employee for a subsequent year. Reduction in Force Non-Renewal of Contracted Employees a. Financial exigencies as declared by the Board of Trustees; b. Termination or reduction of programs as approved by the Board of Trustees; c. Loss of student enrollment; d. Malfeasance, inefficiency, incompetence, insubordination, or contumacious conduct; e. Breach of the employment contract or the college’s policies, rules, and/or regulations by the employee; or f. For other good cause. An employee who has a written contract of employment with the college and who is recommended for dismissal/termination of employment from the college prior to the expiration of that contract has the Dismissal/Termination of Contracted Employees Contracted employees may be dismissed from employment with the college for the following reasons:
